वकील भी सच्चे हो सकते हैं
लोग कहते हैं कि वकीलका पेशा ही झूठका पेशा है। ‘घोड़ा घाससे यारी करेगा तो खायेगा क्या ?’ वकील झूठ न बोलेगा तो कमायेगा क्या? बात ऐसी नहीं है। वकील भी सच्चे हो सकते हैं, अच्छे हो सकते हैं। गाँधीजी, मोहनदास करमचन्द गाँधी ऐसे ही वकील थे। दादा मावलंकर, गणेश वासुदेव मावलंकर ऐसे ही वकील थे। जाजूजी, श्रीकृष्णदास जाजू ऐसे ही वकील थे। ये लोग हमेशा सच्चे ही मुकदमे लेते। यदि बीचमें कहीं पता चल जाता कि मुकदमा झूठा है तो वहीं उसे छोड़ देते। साथ ही इस बातकी कोशिश करते कि लड़नेवाले पक्ष जहाँतक हो, लड़ें नहीं। आपसमें मिल जायँ
सच्चा और अच्छा वकील ऐसा ही करता है।

गाँधीजीको अफ्रीकामें एक मुकदमा मिला। लाखोंकी सम्पत्तिका मामला था। मुकदमा चलानेवाला पक्ष जीत गया। तभी गाँधीजीको पता चला कि इसमें हिसाब किताबकी कुछ गड़बड़ी है। उन्होंने कहा कि मैं इसे जाहिर कर दूँगा, फिर फैसला कुछ भी हो।
उनका बड़ा वकील गुर्राया-‘तब मैं इसमें वकालत न करूँगा।’
‘ठीक है। आप मत करिये। मैं करूँगा।’ गाँधीजीने कहा। जजको गाँधीजीने सारी बातें विस्तारसे समझायीं। वह मान गया। फैसला विपक्षमें दे दिया। सत्यकी विजय हुई।

दादा मावलंकरने वकालत शुरू की थी, तभी बेदखलीके कुछ मुकदमे उन्हें मिलने लगे। एक डिप्टी कलेक्टर उनका मित्र था। वही सुननेवाला था उन बेदखलीके मुकदमोंको। मावलंकर ताड़ गये कि ये मुकदमे लेकर लोग इसलिये मेरे पास आये हैं कि अफसर मेरा मित्र है।
उन्होंने इन लोगोंसे पूछा – ‘इस अफसरसे मेरी दोस्ती है, इसलिये आप मेरे पास मुकदमा लाये हैं कि आपके पक्षमें फैसला करा दूँगा ?’
वे बोले-‘नहीं-नहीं, ऐसीं बात नहीं। हम तो आपका नाम और आपकी तारीफ सुनकर आये हैं।’
‘ठीक है। तब आप घर जाइये और चैनसे आराम करिये। यदि आपको जँचे तो कल मेरे पास आइये। शर्त यही है कि आपको वकीलके नाते मेरी योग्यतापर भरोसा हो, न कि अफसरकी दोस्तीका।’
दूसरे दिन तीस आदमियोंमें सिर्फ एक आदमी अपने मुकदमेके कागज लेकर उनके पास आया।
मावलंकर चाहते तो तीसों मुवक्किलोंको कहकर उनके मुकदमे ले सकते थे। पर सत्यका कोई पुजारी ऐसा कर कैसे सकता है? [ श्रीकृष्णदत्तजी भट्ट ]

Gandhiji got a case in Africa. It was a matter of property worth lakhs. The prosecuting side won. Only then did Gandhiji come to know that there was some accounting problem in this. He said that I will make it public, whatever be the decision.
His senior lawyer growled – ‘Then I will not advocate in this.’
‘Ok. You don’t I will.’ Gandhiji said. Gandhiji explained everything to the judge in detail. He agreed. The verdict was given in opposition. Truth has won.

Dada Mavalankar had started legal practice, only then he started getting some eviction cases. A deputy collector was his friend. He was the one to hear those eviction cases. Mavalankar was shocked that people have come to me with these cases because the officer is my friend.
He asked these people – ‘I am friends with this officer, that’s why you have brought the case to me that I will get a decision in your favor?’
They said – ‘No-no, not like that. We have come after hearing your name and your praise.’
‘Ok. Then you go home and rest in peace. If you like it, come to me tomorrow. The condition is that you have faith in my ability as a lawyer and not in the friendship of an officer.
The next day, out of thirty men, only one man came to him with his case papers.
If Mavalankar wanted, he could have taken the cases of thirty clients by telling them. But how can a priest of Satyaka do such a thing? [Shrikrishnadattji Bhatt]
