यह धन मेरा नहीं, तुम्हारा है

कहते हैं कि सम्राट् अशोक से पहलेकी यह बात है – एक अत्यन्त दयालु तथा न्यायी राजा था। उसके राज्यमें बाघ – बकरी एक घाट पानी पीते थे और कोई किसीको कभी भी सताता नहीं था। उसके राज्यमें लोगोंमें भोगलिप्सा नहीं थी। दूसरेकी वस्तुकी ओर तो कोई ताकता ही नहीं था। इससे कोई मामला- मुकदमा नहीं होता था। कचहरियाँ खाली रहती थीं। नामके लिये न्यायालय था। उसमें एक न्यायाध्यक्ष रहते थे। पर उनके पास कोई काम नहीं आता था।

बहुत दिनों बाद दो पुरुष एक झगड़ेका न्याय कराने न्यायालय में आये। दोनों ही किसान थे। पहलेने कहा न्यायमूर्ति मैंने इनसे थोड़ी सी जमीन खरीदी थी। मैं उसमें खेती करता था। एक दिन मेरा हल जाकर किसी वर्तनसे टकराया। मिट्टी हटाकर देखा तो उसमें हीरे, मोती तथा सोनेकी मोहरें भरी थीं। सरकार! मैंने तो जमीन खरीदी थी। धनका खजाना तो खरीदा ही नहीं था। मुझे पहले कुछ पता भी नहीं था। मैंने इनसे कहा कि अपना खजाना हटा लो; पर ये मेरी एक भी नहीं सुनते। मेरे खेतका काम रुक रहा है।’

दूसरेने कहा-‘न्यायाध्यक्ष ! यह बात बिलकुल सत्य है। पर मैं भला, अपने को इस धनका मालिककैसे मान लूँ? मैंने तो जमीन तथा उसके अंदर जो कुछ था सब इनको बेचकर पूरा मूल्य ले लिया था। अब उसके अंदरका सभी कुछ इनका है। ये मुझे बिना कारण सता रहे हैं। मेरा पिण्ड छुड़ाइये इनसे । ‘

यों कहकर दोनों वहाँ परस्पर झगड़ने लगे और समझाने-बुझानेपर भी दोनोंमें कोई भी उस धनराशिको लेनेके लिये राजी नहीं हुआ। बेचारे न्यायाधीश क्या करते। कुछ देरतक तो वे उन लोगोंके त्याग और निःस्वार्थ भावकी प्रशंसा मन-ही-मन करते रहे। अन्तमें उन्हें एक उपाय सूझा। उन्होंने उन दोनोंसे पूछा कि ‘तुम्हारे कोई संतान है या नहीं ?’ पता लगा कि एकके पुत्र हैं, दूसरेके कन्या है और उनमें परस्पर सम्बन्ध होता है। न्यायाध्यक्षने उन दोनोंसे प्रार्थना की कि ‘यदि आपलोगोंमेंसे कोई भी इस धनको स्वीकार नहीं करना चाहता तो आप अपनी संतानका सम्बन्ध करके उनका विवाह कर दीजिये और सारा धन उनको बाँट दीजिये।’

दूसरे समयके शासनमें तो बिना स्वामित्वका सारा धन सहज ही राज्यकी सम्पत्ति होता। पर आजकी दृष्टिसे यह विचित्र शासन था, विचित्र मुकदमा था तथा विचित्र ही न्याय था। * -जा0 श0

It is said that this is before Emperor Ashoka – he was a very kind and just king. In his kingdom, tigers and goats used to drink water from a ghat and no one ever harassed anyone. There was no indulgence among the people in his kingdom. No one was looking at other’s things at all. There was no case-lawsuit because of this. The courts used to remain empty. There was a court in name. A judge lived in it. But he did not have any work.
After a long time two men came to the court to settle a dispute. Both were farmers. The first said Justice, I had bought some land from him. I used to do farming in it. One day my plow collided with some vessel. After removing the soil, it was filled with diamonds, pearls and gold coins. government! I had bought the land. The treasure of money was not bought at all. I didn’t even know anything before. I told them to take away their treasure; But they don’t even listen to me. My farm work is stopping.
The other said – ‘ Judge! This is absolutely true. But how can I consider myself the master of this wealth? I had taken the full value by selling the land and everything inside it. Now everything inside it belongs to them. They are troubling me without any reason. Get rid of my body from them. ,
By saying this, both of them started quarreling with each other and even after persuasion, neither of them agreed to take that amount. What would the poor judge do? For some time, he kept praising the sacrifice and selflessness of those people in his mind. At last he suggested a solution. He asked both of them, ‘Do you have any children or not?’ It was found that one has a son, the other has a daughter and they have a mutual relationship. The judge prayed to both of them that ‘if any of you does not want to accept this money, then you should get your children married and distribute all the money to them.’
In the rule of other times, all the money without ownership would easily have been the property of the state. But from today’s point of view, it was a strange rule, a strange case and a strange justice. * -ja0 sh0
